This agreement ("Agreement") is entered into between Giacomo Bucci, as composer and provider ("Licensor"), and you, the end user ("Licensee").

By purchasing or downloading a license, you agree to be bound by the terms and conditions below.

1. LICENSE VALIDITY

This license is valid exclusively for the music tracks purchased or downloaded via:

• Official website: https://buy.giacomobucci.com
• Authorized retailer: Lemon Squeezy, LLC ("Lemon Squeezy")

2. LICENSE ACTIVATION SYSTEM

• For each purchase or download, Lemon Squeezy will issue a unique license key;
• The license key must be activated by following the procedures indicated on the website https://license.giacomobucci.com and email;
• Only tracks with a correctly activated license are covered by this agreement;
• The license key serves as proof of legitimate purchase and recognition of the track as well as the license of use;
• IMPORTANT: Save the generated contract carefully as once completed it cannot be regenerated or redownloaded. For further information write to license@giacomobucci.com

3. NO REFUND POLICY

All license purchases are final and non-refundable. By completing your purchase, you acknowledge that:

• Digital products and licenses cannot be returned, replaced, or refunded once the purchase is completed;
• License keys are generated and delivered immediately at the time of purchase;
• Once a license key is issued and/or activated, no refunds will be granted under any circumstances;
• This policy applies regardless of whether the license has been used or activated;
• Exception: Refunds may be considered only in case of duplicate purchases or technical errors preventing license activation and must be requested within 24 hours of purchase.

4. LICENSE GRANT

The Licensor grants the Licensee a non-exclusive, perpetual, worldwide license to use the musical composition(s) specified in the purchase order or download in a single end project, according to the terms of the corresponding license.

Failure to use or improper use of the license key voids the validity of the license itself.

4.2 CLIENT IDENTIFICATION

• Creator License: Licensed to the individual associated with the purchase email address. YouTube Channel ID must be provided for monetization whitelisting.
• Commercial License: May include company/organization name for professional identification;
• Business License: Includes company/client name for commercial projects and client work

The specified client name (for Commercial License/Business License) or email address (for Creator License) constitutes the official Licensee under this agreement.

4.3 CONTENT ID AND YOUTUBE MONETIZATION (CREATOR LICENSE)

The Licensor (Giacomo Bucci) registers all music with Content ID systems (e.g., YouTube Content ID) to protect against unauthorized use. This is a standard practice to prevent third parties from claiming or re-uploading the music.

However, as a Creator License holder, you are granted the explicit right to monetize your YouTube videos that contain my music. To exercise this right:

1. You must activate your license key at https://license.giacomobucci.com and provide your YouTube Channel ID.
2. After activation, you will receive a certificate (PDF) proving your license.
3. Your channel will be whitelisted within 48 hours. Once whitelisted, your videos will not receive Content ID claims from my music, and you will keep 100% of your ad revenue.

Important: If you do not provide your YouTube Channel ID during activation, your videos may be claimed. You can dispute any claim by providing your license certificate. I will release the claim upon verification.

For Commercial and Business licenses, YouTube monetization is also permitted without additional whitelisting steps.

5. RESTRICTIONS

The Licensee may not:

• Sell, resell, or distribute the music "as is";
• Create new tracks based on this music (sample, remix, cover);
• Use the music in music compilations or albums;
• Register the music in any Content ID system (including but not limited to YouTube Content ID, AdRev, etc.) – This right is reserved exclusively for the Licensor;
• Use the music in templates or products intended for resale;
• Create phone ringtones;
• Sell, resell, or distribute the purchased key and license.

6. ATTRIBUTION

For video projects, the following attribution is required in the credits or description:

"Music by Giacomo Bucci | https://giacomobucci.com"

• Mandatory for the Creator License
• Recommended for the Commercial License
• Not required for the Business License

7. BROADCAST USE (TV, RADIO, CINEMA) AND BMI

The Licensor is registered with BMI (Broadcast Music, Inc.).

The licenses granted through this Agreement cover exclusively synchronization rights (sync rights) for web, social, digital content, and commercial projects as indicated in the Creator, Commercial, and Business licenses.

For all broadcast uses, including but not limited to TV, Radio, Cinema, VOD platforms with linear or public broadcast, the Licensee is obligated to:

• Complete and submit a cue sheet to BMI, correctly reporting the track title, composer name (Giacomo Bucci), duration, and type of use;
• Ensure that the broadcaster or platform sends the cue sheets to BMI according to their own policies.

Any royalties derived from public performance rights will be collected by BMI and paid to the Licensor.

Failure to submit the cue sheet constitutes a breach of this Agreement.

8. LIMITATION OF LIABILITY

The Licensor shall not be liable for any indirect, incidental, or consequential damages arising from the use of this music.

The maximum liability of the Licensor shall not exceed the amount paid for the license.

9. MISCELLANEOUS

This Agreement constitutes the entire agreement between the parties.

Any modification must be approved in writing by both parties.

This Agreement is governed by Italian law.
